BASIC CONSTITUTIONAL LAW

 

Chapter 1- The Name and the Seat:

    Article 1:   Name of the union :        World Lebanese Cultural Union .

                   World Lebanese Cultural Union is a civil institution, independent and governmental, non political, non ethnical or racial , non religious , non profit making . It is recognized as the sole representative of the Lebanese Diaspora in the world. It has an unlimited duration and it is subject to its basic constitutional law and to its internal regulations. Each of its organizations, wherever it may be, is entitled to carry the name of the host country in addition to its own name.

  Article 2:   Its Seat : Mexico, AlfredoAtalahCenter

              The Seat may be temporarily transferred to any country by decision of the presiding world council. The decision of the World Council shall be final.

Chapter 2: - Objectives and Measures :

    Article 3: The aims:

(a)- To enhance and promote the spirit of loyalty and nationalism among the members of the Union and their host countries ; to have a factual interest in the well-being of these countries from the educational , civic, social and moral points of view. It is an educational, benevolent and non-profit institution.

(b)- To strengthen the ties of friendship and intimacy among its members, thus resulting in the promotion of mutual friendship and understanding between the host countries of the members of the Union .

(c)- Establishing, promoting and enhancing a relationship of mutual friendship and understanding between these countries and Lebanon ; encouraging and exchanging tourism and educational, social, and economical activities for the mutual benefit of Lebanon and the host countries, and for the welfare of the Lebanese nationals and the Lebanese descendants.

(d)- To spread the Lebanese legacy in the host countries of the members of WLCU, to spread the legacies of these countries in one another and in Lebanon ..

(e)- To introduce the culture of Lebanon and the role it played, free of purpose, for the service of humanity throughout its history; to preserve the existence and nature of Lebanon so that it may continue to contribute to the world peace and understanding among nations .

(f)- To enhance confidence, peace and understanding among human beings by encouraging the members of WLCU to serve their communities irrespective of personal

or financial gain , and to endeavor to raise the moral levels in the fields of trade, public works, and personal life.

   

Article 4- WLCU will also endeavor to accomplish its objectives which aim at:

(a)- To back the existence, sovereignty, and independence of Lebanon as a final homeland to all Lebanese nationals; to manifest the distinguished identity of the Lebanese   Diaspora, and to organize such Diaspora and make it more effective.

(b)- To provide all available facilities and services to the Lebanese emigrants and their descendants .

Chapter 3- Membership and affiliations

Article 5 - WLCU is composed of those chapters, clubs, societies, confederations, institutions and unions that comprise Lebanese nationals and descendants of Lebanese origin who believe in Lebanon as a final homeland to all its people, and who are not members of establishments that have contradicting objectives to the existence of Lebanon.

Article 6 - WLCU comprises the named members spread in the following geographical regions:

            -Africa.

            -Europe.

            -Brazil.

            -Spanish America & the Caribbean.

            -USA & Canada.

            -Australia &New Zealand.

 

Article 7 –

(a)- Representatives of each geographical region share in the elections of the geographical committee in the region to which they belong. Each representative will have a number of votes equivalent to the number of members of the represented chapter, club, society, confederation, institution or union, provided it is licensed in accordance with the rules and provisions of the internal regulations .

(b)- the World Secretary General or his regional delegate will supervise the elections of the Committee of the geographical region. This rule will not apply to regions with one union, e.g. Brazil.

 

Article 8 - Members of WLCU, in the said regions, will comply with the objectives of WLCU. The basic constitutional law and internal regulations of WLCU become applicable to the members through their mere affiliation to it. The conditions and terms for the affiliation of chapters, clubs, societies, confederations, institutions and unions to WLCU are defined in the internal regulations .

Chapter 4 - Organizations of WLCU:

   Article 9- WLCU comprises nine organizations:

1)-The World Conference

2)-The World Council

3)-The World Secretariat General

4)-The advisory Council

5)-The Board of Trustees

6)-The Arbitrary Council

7)-The World council for Youth

8)-The World Committee for Ladies of Lebanese Descent

9)-The Committee of International Relations

 

   Article 10- The internal regulations define the conditions and procedures of work within each organization and within what belongs to it or is derived from it .

  

   Article 11- The world President and three Vice Presidents are elected during the World Conference by the representatives of the member organizations, whereas each representative is allowed one vote. The term of the World President is two years. The World President is not permitted to be re-elected for this seat two consecutive terms. A senior member selected by the General Assembly shall supervise the elections of the World President.

 

  Article 12-  The WLCU World President, represents WLCU officially in Lebanon, in the host countries of the Lebanese Diaspora , and at international official and private organizations, he is represented in each geographical region by the President of the Committee of the Geographical Region.                                                                   

 

    Chapter 5 - Resources of WLCU:

    Article 13 - The financial resources of WLCU comprise the following:

      - Subscription fees paid by subscribed members.

      - Aid contributions made by international organizations.

- Aid contributions made by Lebanese societies and clubs in the host       countries of the Lebanese Diaspora.

 - Gifts, donations and contributions.                                                                                                                                      

 

     Article 14- Upon dissolution and liquidation of WLCU, its funds will become property of the Lebanese Red Cross Society.

     Article 15- The General Assembly is the only conference entitled to amend this basic constitutional law, provided the amendment is made in a general meeting, ordinary or exceptional, and approved by two thirds of the attending members:

(a)- The President shall propose the amendment.

(b)- All members of the electing organizations in the World Conference are entitled to submit their proposals for any amendment to the World Secretariat General. Such proposals should reach the World Secretariat General at least one month before the conclusion of the world conference.

(c)- The World Secretariat General shall propose the amendments in consultation with the Advisory Council .

(d)- The General Assembly shall amend this basic constitutional law  by the absolute majority of the attending members during a normal or exceptional meeting with legal quorum .


     Article 16 - The internal regulations of WLCU will be attached to this basic constitutional law. They are considered a complementary part of it.

   

     Article 17- The official languages of WLCU are: Arabic, Spanish, English, Portuguese and French. Use of the Lebanese spoken dialect is permitted in discussions, conferences, meetings and lectures.

 

     Article 18- The original text of the basic constitutional law was written in Arabic. It is the applicable text in case of conflict regarding the explanation or application of the translated texts.

 

     Article 19- The current basic constitutional law approved for WLCU during the Exceptional World Conference held in San Paulo, Brazil on 16 September 1994 will apply with all its provisions, rules, articles and sentences, with The following amendments which were approved during The World Conference held in Mexico City, Mexico on May 12, 2001:

(a)    The abolition of the Presidential Council and the integration of the World Council as follows:           

- President

- 3 Vice Presidents

- World Secretary General

- World Treasurer

- 10 Vocals

(b)   The formation of the Commission of International Relations which aims at establishing relations with all international organizations and diplomatic missions in order to become an international entity and an INGO.      

(c)    The change of the World Committee for youth to World Council for Youth.

(d)   To give authority to the new World Council to make the necessary adjustments and amendments to the Reglamentary Articles to be in accordance with the changes approved for the basic Constitutional Law.

Internal Regulations

 

Chapter 1- Membership and affiliation:

First -Affiliation of Individuals:

 

Article 1- Every Lebanese National or descendant of Lebanese origin, whatever citizenship he/she may hold, who complies with article (3) paragraph (f) and article (5) of the basic constitutional law and dwells in any of the geographical regions enumerated in the basic constitutional law, is entitled to affiliate to WLCU.

Article 2- An application for membership in any host country will be submitted to the concerned branch in accordance with the membership conditions set therein.

Article 3- The branch shall issue to each of its members a membership card signed by the World Secretary General of WLCU and by the officer in charge of the branch . This card is renewable yearly.

Article 4- Upon a special request made by a member, WLCU shall issue him an honorary membership cards signed by the president of WLCU  and the World Secretary General .

Article 5- Each member holding a duly renewed membership card shall be entitled to benefits, advantages, facilities and discounts provided by WLCU.

 

Second - membership of branches, clubs, societies, confederations, institutions and unions .

Article 6-Membership qualification of WLCU is confined to the current branches and to those that shall be established in the future . Clubs, societies, confederations, institutions and unions shall be considered branches whenever they subscribe to WLCUand are duly accepted.

 

 

 

 

Article 7- A branch shall consist of a minimum of thirty members properly qualified for membership and holding duly renewed membership cards. Each such member is entitled to one vote in the election of the branch board. No one is entitled to membership in more than one branch .

Article8- (a)- An application for establishing a branch shall be submitted to the Secretariat General after an endorsement by the National or State council , if available in the concerned country.

               (b)- The National or State Council shall forward the application to the Secretariat General within a maximum period of two months from the date of its submission, otherwise it may be submitted directly to the Secretariat General .

3rd-The branch is considered duly established once the Secretariat General is satisfied of its compliance with the regular set conditions. The World secretary General shall then take the decision for establishing the branch and advise the National or State Council accordingly after registering such decision in the files of the Secretariat General.

Article 9-Such a branch is considered a legal entity and enjoys administrative and financial independence. It shall establish its own regulations provided that such regulations do not contradict the World Basic Constitutional laws, the World Internal regulations, and the local current laws and regulations.

Article 10-The members of a branch shall elect from within their ranks the president and the board of directors. The elected president shall be legally considered a member of the National or State Council in the host country or state .The president of the branch shall advise the Secretariat General through the National or State Council of the internal regulations of the branch as well as of its address and the names and addresses of its members with samples of their signatures and the signatures of the Board members .The president shall also submit to the World Secretariat General and to the National or State Council to which his or her branch belongs, a yearly report on the activities of the branch.

Chapter two - General Organizations                                                                         Article 11- WLCU comprises nine organizations:

                                              2-   The World Council

                                              3-   The World Secretariat General

                                              4-   The Advisory Council

                                              5-   The Board of Trustees

                                              6-   The Arbitrary Council

                                              7-   The World Council for Youth

                                              8-   The World Committee for Ladies of Lebanese Descent.

                                              9-   The Commission of International Relations

 

 

 

 

 

 

First - The World Conference :

Article 12- A- The World conference consists of the presidents of branches, clubs, societies , confederations, institutions and unions; of the presidents of national and state councils; of the chairmen of the world council for youth and the chairman of the World Committee for Ladies of Lebanese Descent ; of members of Geographical Regions committees and the World Secretary General.

2nd-Each head of organization is entitled to be represented in any session of the conference by a delegate whom he or she selects from the members of the organization over which he or she presides. He or she shall provide such delegate with a written power of attorney for an assigned session. The power of attorney shall bear the stamp of the organization and the signature of the president of the organization.

Article 13- The World Conference is the highest authority of WLCU. It lays down and amends its regulations and controls all its organizations in view of meeting its objectives.

Article 14- A- The World Conference shall, virtually, convene in an ordinary general assembly meeting once every two years, whether in Lebanon or outside it. This meeting shall be called for by the president through the World Secretariat General.

                  B- The Secretary general shall call for the meeting, and send the agenda of work to each organization by registered mail or by any known means of serving, within a minimum period of three months before the date of the meeting of the conference .

                  C- During the session of its ordinary meeting, the conference shall be chaired by the World President of WLCU. He shall be assisted by the secretary general and six auditors, one from each geographical region. The auditors shall register the names of the attending members and verify the legality and outstanding of each of them. They shall verify the forum and the numbers of votes.

4th- The World Secretary General shall write the minutes of the meeting and sign them together with the president.

5th-A forum is attained in the first ordinary session of WLCU by the attendance of the absolute majority of the invited members; otherwise by whoever attends in the second session which shall be

held, virtually , within two hours of the prescribed time of the first meeting.

6th-The general ordinary meeting of WLCU takes its decisions by proportional majority of the attending members.

                      G - The session shall be opened by stating that forum has been attained and by reading the agenda of work which comprises:

  1-  The report and approval of the president.

  2-  The administrative and financial reports and the approval of the World Secretariat General.

  3-  Taking a decision on a plan of work of WLCU during the coming two years.

Article 15-1- A non ordinary (exceptional) meeting of the world conference shall be held whenever necessary:

 

One-Upon a request of the majority of the attending members of an ordinary or exceptional meeting of the World Conference.

Two- Upon the request of the president.

  2- The same procedures applied for calling an ordinary general assembly of WLCU shall be followed. Meetings of non ordinary (exceptional) sessions shall be chaired by the World President.

  3-  A forum is attained in the first non ordinary session of the World Conference by the attendance of two thirds of the invited members; otherwise by whoever attends the second session which will be held, virtually, within two hours of the prescribed time for the first meeting.

  4- Decisions of WLCU general non ordinary meetings shall be taken by a two thirds majority of the attending members.

Article 16-During World Conference meetings, ordinary and exceptional, voting on decisions shall be made by hand raising. Each member shall have one vote provided that Brazil is credited with one third of the votes and the other two-thirds are credited to the remaining geographical regions combined together.

 

 Second - The World Council :

Article 17- The World Council consists of:

     The World President, the Vice-Presidents, the World Treasurer and the Vocals.

     The Secretariat General, which includes the World Secretary General, the Deputy World Secretary General and the Regional Secretaries General.                           

     Presidents of National and State councils.

     Chairmen of the Committees of Geographical Regions

     The Chairman of the World Council for Youth.

     The Chairman of the Committee for Ladies of Lebanese Descents.

     The Chairman of the Committee of International Relations.

 

Authorities of the World Council

Article 18 - A-The World Council shall have the power to:

  1-  Supervise the execution of the decisions of the world conference by executive organizations of WLCU.

  2-  Study and discuss and approve the yearly budget of WLCU.

  3-  Take the necessary recommendations and decisions to be applied by the executive organizations of WLCU.

  4-  Call for the world Conference meetings in ordinary and exceptional sessions (Article 15-par1-a).

2nd- The World Conference will virtually, meet once a year whether in Lebanon or outside it, as specified in the addressed call.The World President will call for the meeting through the World Secretariat General.

                     An exceptional assembly of the World  Conference will be held upon a request from the World President, or upon a recommendation made to the President by the Secretariat General or by any of the committees of the geographical regions .

      The President will take his or her decision regarding the recommendation within one month from the date receiving it. Within one month from its acceptance, when accepted, the President shall then address a call for the meeting of the world conference.

3rd-The World President shall chair the meeting and shall be assisted by the World Secretary General and by six auditors appointed by the president, each auditor representing one geographical region.

4th-A forum is attained in the first session by the attendance of half of the invited members plus one; otherwise by whoever attends the second session which shall be held, virtually, within two hours of the prescribed time of the first meeting.

           E-Decisions shall be taken by absolute majority and voting shall be made by hand raising, consideration being taken of article16.

           F- Each member of the world conference may delegate a selected member of the organization which he presides, to represent him in a specified session, provided he gives that delegate a written power of attorney bearing the stamp of the organization and the signature of the presidency of the organization.

 

Third -Committees of the Geographical Regions:

Article 19- Each of the committees of the geographical regions consists of the president of National or State councils in that geographical region of the Diaspora countries as defined by the laws.

Article 20- Committees of the geographical regions are empowered to execute the decisions of the world conference, and to coordinate the work and decisions of the national and state councils in each geographical region for ensuring cooperation and integration between them.

Article 21-A-Committees of geographical regions shall write down their own internal regulations taking into consideration the objectives of WLCU and abiding by the World Constitutional Basic laws and World Internal Regulations and local laws of the countries of the Diaspora. A copy of such regulations shall be served to the World Secretariat General.

                  -B- Committees of geographical regions shall meet once every two years in a date not conflicting with the dates of the world conference meetings.

3rd-Each committee shall elect its president and administrative board in the same way as stated in article 7 of the basic constitutional laws. The term of such president and board shall be for two years non extendible and non renewable until a term has elapsed.

 

Fourth - The National Councils:

Article 22- The National or State Council shall consist at least, of the presidents of three branches, clubs, societies, confederations, or unions affiliated to WLCU in the Lebanese Diaspora countries.

Article 23- The National or State Council is empowered to execute the decisions of the world conference and those of the world council and to coordinate between the branches, clubs, societies, confederations and unions of the hosting country to ensure cooperation and interaction between them.

Article 24- The National or State Council shall hold its annual meeting on a date not conflicting with the date of meeting of the world council and of the continental conference. It shall elect, from the ranks of its members, for a term of two years, an administrative board which comprise a president, a vice president, a treasurer and councilors. The president is not to be re-elected before the expiry of two years after his previous term.

        Minutes of the election session together with a list of the elected members of the board, their full addresses and samples of their signatures shall be served to the central secretariat general.

         The national or state council shall write down its own internal regulations taking into consideration the objectives of WLCU and abiding by the constitutional basic law and internal regulations of WLCU and local laws of the countries of the Diaspora. A copy of such regulations shall be served to the central secretariat general.

         In countries or states where incorporation with another state is not feasible, a single branch may form a national or state council after obtaining the approval of the world secretariat general for considerate excuses.

Article 25- Where necessary for reasons of internal organization in some geographical regions, national councils may be replaced by Provincial councils that comprise the organizations affiliated to WLCU. Such provincial councils may form, jointly, a council of geographical region when a justified approval is given by the world secretariat general and endorsed by the president.

The President:

Article 26- The World President and three vice presidents are elected by secret voting in the same way as stated in article 7 of the Basic constitutional law. The term of the World President and the vice presidents shall be for two years non extendable and non renewable until one term has elapsed.   

Authorities :

Article 27-The president, during his term, chairs the meetings, signs the correspondence, and represents WLCU.

Article 28- The president is considered the executive authority in WLCU. He or she organizes, directs and administers the affairs of WLCU, in general, and supervises the execution of the decisions taken by the world conference and by the world council in particular.

Article 29- The president is responsible before the world conference for any violations he or she commits against the law and against regulations of WLCU. The world conference has the right to dismiss the president before the end of his or her term by taking an irrevocable ratified decision to this effect in an exceptional general meeting. .

 

 

 

 

 

 

 

 

Article 30- During the world conference meeting, the president shall appoint, for a renewable term of two years, a world treasurer and a world secretary general who shall administer the affairs of WLCU assisted by a deputy secretary general and six regional secretary generals to be appointed upon his recommendation. The secretariat general is responsible towards the president for violations committed by itself against the law and regulations of WLCU. The presidential council has the right to dismiss the secretary general for the following reasons:

         The secretary general shall be automatically dismissed when he commits a major mistake or violates the regulations of WLCU, or the decisions of the conference or of the world council, or when he causes damage to WLCU. Such dismissal shall be affected in accordance with the procedure of appointment.

         The president is entitled to dismiss regional secretaries general upon the recommendation, with justified pretexts, of the secretary general.

The Secretariat General :

Article 31- The secretariat general consists of the secretary general , of assistant secretaries general appointed in accordance with article 37 of these regulations , of officials appointed by the secretary general as needed and in accordance with internal regulations laid down by the secretary general and approved by the president. Such regulations shall prescribe the establishment of the officials , their remuneration , and their discharge taking into consideration the jurisdiction of the Lebanese labor law .

Article 32-The secretary general has the authority to implement the plans and execute the decisions of the president, and is responsible, in doing so and due to his delegation, for all matters included in the authorities of the president and particularly the following:

     To ensure realization of the objectives of WLCU as defined in the basic constitutional law.

     To ensure execution of the decisions taken by the world conference and the world council through the president in accordance with article 28.

     To address a call to the world conference for the meetings of the general assembly.

     To address a call to the world conference to convene.

     To accept affiliations to WLCU and to issue membership cards.

     To authorize and supervise the establishment of branches and to allow the establishment of more than one branch in one city.

     To coordinate the work of the committees of geographical regions and of the national and provincial councils and of branches and organizations.

     To render judgment in differences between members and organizations of WLCU such as national and provincial councils and those of lower level .

     To appoint specialized committees for executing the objectives of WLCU.

     To appoint administrative, technical and counseling officials.

     To sign correspondence and powers of attorney.

     To administer the funds of WLCU and sign financial transactions with the World Treasurer, and to assign a legal auditor, to be appointed by the president, for auditing the books and certifying the budget and submitting a yearly financial report to the world conference.

     To attend the meetings of the world conference and of the world council, and to write the minutes of the meetings, personally or through a delegate, and to sign such minutes with the president of the meeting organization. To attend, also whether personally or through a delegate the meetings of committees of geographical regions and the elections of the boards of such committees.

     To serve, whenever necessary, the decisions of the world conference, of the world council and of the other organizations.

     The remuneration of the secretary general shall be defined in accordance with the recommendation and approval of the world president.

     During the absence of the secretary general he shall be represented by the Deputy Secretary General or any Regional Secretary General whom the secretary general may delegate.

     When the position of secretary general becomes vacant it shall be filled by the Deputy secretary general pending the appointment of his successor ..

Article 32- The regional secretaries general shall assist the World secretary general upon delegation from him. He calls them to meetings of the secretariat general , ordinary and exceptional , so that they submit their reports on the work delegated to them .

Article 33- The secretary general assigns the functions and authorities of the regional secretaries general according to the following specialties:

     Assistant secretary general for administrative affairs.

     Assistant secretary general for financial affairs.

     Assistant secretary general for committees affairs.

     Six regional secretaries general, who reside and work abroad, for regional affairs.

Article 34- Each assistant secretary general represents the World secretary general within his specialty.

The Assistant Secretary General for Administrative Affairs:

This task could be assigned to the Deputy Secretary General.

-He Keeps the files of meetings in order, decisions and recommendations relating to the organizations of WLCU, in particular, the general assembly and the executive and advisory boards.

 -Receives the incoming mail and submits it to the secretary general who refers the correspondence to the concerned authorities.

 -Writes the minutes of the secretariat general and signs them with the secretary general.

 -Is in charge of the records and documents of WLCU, of lists of names, addresses and dates of affiliation of the members and branch ID cards etc.

-Is in charge of distributing membership cards, of receiving and delivering the incoming funds and donations.

-Represents the secretary general during his absence.

The Assistant Secretary General for Financial Affairs:            

-He is responsible for the funds of WLCU and signs the financial transactions with the secretary  general.

-collects subscriptions, contributions and donations against receipts with stubs.

-holds a legal accounting system assisted by experienced specialists.

-deposits in one or more banks, assigned by the secretary general , whatever exceeds $1000of the funds of WLCU.

-prepares the yearly budget and submits it to the secretary general.

-Represents the assistant secretary general for administrative affairs during his absence.

The Assistant Secretary General for Committees Affairs : 

-He supervises the concerned committees, coordinates their work and writes a yearly report on their activities .

-seeks, with the consent of the secretary general , the help of experienced persons and institutions for preparing studies that facilitate the work of the committees .

-is served with the recommendations of the concerned committees, and refers such recommendations to the secretary general with his comments .

The Assistant Secretary  General for regional  Affairs :

         -The central secretary general delegates to each assistant secretary general, within the framework of his specialty , some functions to be defined by a decree that holds him responsible for them towards the central secretary general , such as ;

         - To coordinate with the president of each committee of a geographical region , and with the presidents of the national and provincial councils the execution of all matters delegated to him .

Third - The specialized committees:

Article 35- The secretary general shall appoint specialized committees of experts , each composed of, at least , a president and a reporter for accomplishing certain defined missions . Such committees are the following:

-Financial Committee-To look after means of promoting the resources of WLCU, to recommend priorities of spending such resources, and to provide financial investments.

-Economic Committee -To study how emigrants may contribute in rebuilding Lebanon and to strengthen the economic relation between Lebanon and their hosting countries.

      -Information committee - To contribute in the exchange of video, audio and written information programs between Lebanon and the hosting countries.

      -Social Committee - To study means of helping and supporting the needy and afflicted people in Lebanon and in the Diaspora, and to advise and direct the youth towards careers needed for labor market in Lebanon and in the Diaspora.

-Educational Committee - To spread the Lebanese legacy in the countries of the Diaspora, and to encourage opening schools for teaching the Arabic language.

- Advisory committee - To provide, upon request, the necessary counseling and guidance to affiliated members of WLCU.

- Organization Committee- To prepare programs for conferences, and to plan for realizing the objectives of WLCU and promoting its efficiency.

- Statistical and Authenticating Committee - To look after authentication matters in general, to raise detailed list of such matters, and to look after statistical affairs.

Article 36- The specialized committees shall make recommendations to be served to the assistant  secretary general for committees affairs who refers them, with his comments, to the central secretary general for taking the appropriate decision .

Article 37- The secretary general has the right to appoint other specialized committees, when necessary, upon the recommendation of the assistant secretary general for committees affairs and after consulting the advisory council of WLCU.

Chapter four

First - The Advisory Council:

Article 38- The advisory council of WLCU is the juristic board of WLCU .

Article 39- The advisory council is composed of permanent members consisting of previous presidents and previous secretaries general of WLCU, and of previous secretaries general of the world council for youth of Lebanese descent; and of an equal number of members  selected and proposed by these permanent members, from regional and world celebrities among emigrants , and from those who rendered good service to WLCU. Each of such members is subject to approval by the world conference in an ordinary general assembly meeting that shall be held every six years. Article 40- A- As soon as established, the advisory council shall convene under the chairmanship of the most senior of its members, for agreeing on naming or electing, in case of disagreement, two of the members as president and vice president.

                  B- In the same place and at the same date that the world council and world conference hold their yearly meetings, the advisory council shall, virtually, convene every year for agreeing on naming or electing its new president and vice president, for noting the names proposed by the secretariat general as members of the board of trustees and of the arbitration council, and for giving their comments on any subject proposed by the secretariat general including agreements, protocols, and contracts.

3rd-The reporter shall write the minutes of the meeting and submit them to the world council.

4th-The most senior vice president shall represent the president during his absence. In case of absence of all, president and vice presidents , the meeting shall be chaired by the most senior attending member.

5th-The secretary general or his delegate is considered reporter to the advisory council.

6th-Forum shall be attained upon attendance of, at least, one third of the members in the first session, and by whoever attends in the second session which shall be held in the following day to that of the first session.

7th-Call for the meeting shall be addressed, at least, one month before its assigned date. Decisions shall be taken by the majority of the attending members.

Second – Board of trustees:

Article 41-The board of trustees consists of the following personalities:

             Head of states, ministers, senators, members of parliament and other specialized prominent personalities among Lebanese emigrants.

Article 42- Every year, the world conference proposes names of new members of the board of trustees after taking their consent or noting their wish to join the board of trustees, and send a list of their names to the advisory council for information. The secretary general or his delegate shall act as reporter to the board of trustees.

Article 43-The board of trustees gives the necessary instructions for consolidating cooperation betweenLebanon and the countries of Diaspora.

Article 44- Irrespective of forum, the board of trustees shall meet whenever the president of the WLCU or some members of the board of trustees deem necessary. The attending members name, by agreement, one of them to chair the meeting, The directives of the board of trustees are issued by agreement between members or through voting. Such directives are submitted to the central secretariat general for circularizing to the organizations of WLCU and for follow up.

Third - The Arbitration council:

Article 45-The arbitration council consists of three basic members and of two substitute members to be selected by the world council among men of law affiliated to WLCU.

Article 46-The world council shall nominate, yearly, the members of the arbitration council in accordance with article 38 of these regulations. It shall, also, specify the names of the president and of the two counselors among the two substitute members.

Article 47-The arbitration council shall arbitrate in any disputes or differences arising about the explanation or the application of the basic constitutional law and internal regulations of WLCU. It shall, also, arbitrate in all disputes and differences among the organizations and members of the superior board of WLCU.

Article 48-Each of the conflicting parties shall submit a written list comprising its statements and requests. The arbitration council has the right to summon before it both parties or one of them. The arbitration council shall give its judgment as an absolute arbitration. Its decisions are final, binding to the conflicting parties, and not subject to any means of review. The arbitration council is, also, entitled to take, upon the recommendation of the world president of WLCU or the central secretary general, any disciplinary measures it may deem necessary against the members who contravene the jurisdiction of the basic constitutional law and the regulations of WLCU, as well as against those who cause damages to WLCU and its organizations. Such measures include:

    -Cautioning -blaming - rebuking -suspension of membership of the culprit for a period to be defined by the arbitration council , and dismissal from WLCU.

Chapter five - Resources of WLCU:

First - subscription fees:

Article 49- The resources of WLCU consists of yearly subscription fees, helps, gifts and contributions in accordance with article 13 of the basic constitutional law.

Article 50- The yearly subscription fee is $20 per affiliated member. The secretariat general is entitled to amend the amount of the yearly fee after consulting the advisory council. A new yearly fee shall become due at the beginning of each fiscal year. A fraction of a year is considered one complete year.

Second - Funds of WLCU

Article 51- A- The funds of WLCU shall be deposited in its name in or more banks named by the president and secretary general of WLCU , provided that the assistant secretary general for financial affairs hold a proper accounting system and that the books and yearly budget are audited and signed by a legal auditor in accordance with the jurisdiction of article  -- ,para.B.

2nd-Spending of funds shall be made against checks or payment vouchers signed both by the president of WLCU or his delegate, and by the secretary general or his delegate .

Article 52- Spending the funds of WLCU shall be made by decision of the secretary general .The assistant secretary general for financial affairs shall pay the amounts assigned in the decision against a payment voucher signed by the secretary general stating the name of the beneficiary, date, and the reason for expenditure.

Article 53- In a yearly ordinary meeting of the world council of WLCU , the secretary general shall assign the remuneration of committees and counselors within the budget for emergency reasons are subject to approval by the president of WLCU.

Third - The Fiscal Year:

 Article 54- The fiscal year begins on the first day of January of each year and ends on the thirty first day of December of the same year .As an exceptional case , the current fiscal year begins on the date of approval of the new basic constitutional law and the internal regulations and ends on the thirty first of December of the same year . An inventory of WLCU funds, movable and non movable, shall be held and the balance carried forward to the account of the said year.

Article 55- On the first month of each year, the secretary general shall submit to the presidential a financial report requesting the approval of the accounts of the past year and the clearance of the account of the secretariat general. He shall attach to the said financial report the yearly report both of which are prepared by the accounts controller appointed by the president.

Chapter six - The World Council for Youth:

Article 56-Each national council shall form a committee for youth descendant of Lebanese origin. Such committee shall be considered part of the national council.

Article 57- All committees for youth descendant of Lebanese origin shall form together one world committee for youth of Lebanese descendants presided by an elected chairman who shall coordinate with the central secretary general of WLCU.

Article 58-The world council for youth shall lay down its own internal regulations or approval by the world council of WLCU.

Article 59- The chairman of the world council for youth shall have the capacity of vice president having right to discussion and voting. He shall be, also, a member of the world council.

Chapter seven - Amendment of the internal regulations:

Article 60 - The same procedure applied for amending the basic constitutional law shall be followed for amending the internal regulations.

Chapter eight - Agreements:

Article 61- 1-Through its president, WLCU may conclude a cooperation agreement with the State of Lebanon represented by the concerned ministries for coordinating the common work in the fields of emigration affairs.

  2-  Through a decision of its president, WLCU has the right to conclude agreements with any group or union of emigration clubs not affiliated to WLCU but fulfilling all conditions for affiliation.

  3-  Through a decision of its president, WLCU may conclude, within the scope of its aims and objectives and in accordance with these regulations, educational, technical, social, economical or sports agreements with any national or world organization or with an international institution.

  4-  Through a decision of its president, WLCU has the right to cooperate with any similar organization in any country for mutual interest and for the benefit and good of the Lebanese citizens in Lebanon and in the Diaspora.

  5-  Through a decision of its president, WLCU has the right to sign contracts.

  6-  In accordance with these regulations and after the approval of the world secretariat general, continental committees, national councils, branches and institutions affiliated to WLCU in the Diaspora have the right to conclude cooperation agreements among themselves and with other institutions, clubs, and societies for achieving the aims and objectives of WLCU.

Chapter nine - General Regulations:

Article 62- No person is allowed to hold two positions with the exception of the president of a national or state council who must be, in the same time, president of a branch, club, society, confederation, institution or union.

Article 63-These regulations shall be attached to the basic constitutional law and are considered a complementary and integrated part of it.

Article 64-These internal regulations have been approved in the exceptional world conference held at San Paulo in Brazil between 20-22 May 1993. It is considered an integrated part of the basic constitutional law that was , also , approved in this conference and became effective in accordance with the contents of that said law. These internal regulations have been amended in the twelfth World Conference held in Mexico City, Mexico on May 12th 2001.
